The United States advised against traveling to solely for the purpose of childbirth

To all individuals from the Island seeking to have children in the United States, the Trump Administration has implemented a suspension of practices associated with what is commonly referred to as “birth tourism.” This issue has been a significant focus for the Administration, which seeks to eliminate birthright citizenship. Currently, the Administration’s position is under judicial review.
Nonetheless, a more direct approach is being taken, as the Administration advises against this practice and utilizes the immigration office to deny visitor visas if it is believed that the purpose of travel is to give birth in the United States. Moreover, the use of Medicaid or other U.S. government assistance for medical care may affect the future eligibility for visa renewal.

A statement on the United States Embassy social media page reads, “using your visa to travel for the primary purpose of giving birth in the United States, so that your child will have U.S. citizenship, is NOT permitted. Consular officers will deny your visa application if they have reason to believe this is your intent. Furthermore, if you already have a visa and travel to the United States for the primary purpose of giving birth, and you use Medicaid or other U.S Government assistance to pay for your medical care, you may not be eligible to renew your visa in the future.”

In addition, Republican Senator Marsha Blackburn of Tennessee introduced new legislation on Tuesday May 20-2025, targeting the dismantlement of what she sees as the multimillion-dollar birth tourism industry. Which she believes enables foreign nationals to exploit the United States immigration system to obtain automatic citizenship for their offspring. The Ban Birth Tourism Act, presented in the U.S. Senate, seeks to amend the Immigration and Nationality Act to render inadmissible any foreign national applying for a tourist visa primarily for the purpose of giving birth in the United States.

Those births automatically trigger U.S. citizenship for the child, a long-criticized loophole that opens the door to future family-sponsored migration.

“For too long, foreign nationals have been exploiting our nation’s immigration laws, taking advantage of the system to come to the United States solely to give birth and obtain citizenship for their children,” Blackburn said in a press release

“The Ban Birth Tourism Act would prevent foreign nationals, including those from adversaries like Communist China and Russia, from buying American citizenship for their children. As President Trump works to end birthright citizenship, we need to get this bill to his desk.”
